Important distinction (therapy confidentiality & HIPAA):
This Privacy Policy explains how the Site handles information. If you are a client receiving clinical services, additional federal and state confidentiality rules may apply to your health information. Where applicable, we will provide—or have provided—you a separate HIPAA Notice of Privacy Practices describing how we use and disclose Protected Health Information (PHI). If there is any conflict, the HIPAA Notice controls for PHI.

Information we collect

  1. Information you provide directly
    • Sensitive information: Please avoid sharing clinical details through general contact forms or email. Use the secure client portal (if applicable) for anything health-related.
    • Contact & inquiry data (e.g., name, email, phone, message contents) when you submit forms or email us.
    • Account/scheduling details if you book, register, or complete intake through our Site or linked platforms (e.g., preferred appointment times).
    • Payment details if you pay online (processed by our payment processor; we do not store full card numbers).
  2.  Information collected automatically
    When you visit the Site, we (and our service providers) may automatically collect:
    • Cookies & similar technologies: small files used to operate, secure, and improve the Site. See “Cookies” below.
    • Log & device data: IP address, browser type/version, device identifiers, operating system, referring/exit pages, date/time, and general location inferred from IP.
  3. Information from third parties
    If you use integrated tools (e.g., scheduling, telehealth, payment, video hosting, analytics), those providers may send us limited information needed to complete your request, consistent with their own policies.

How we use information

We use the information described above to:

No advertising profiling: We do not sell your personal information or use interest-based advertising/remarketing on this Site.

We retain personal information only as long as necessary for the purposes described or as required by law and professional standards. If you are a client, clinical record retention follows applicable law and professional rules.

Your choices & rights

Email/SMS preferences

You can opt out of non-essential communications by following unsubscribe instructions or contacting contact@tikvahhealinggroup.com. Transactional or service messages (e.g., appointment details) may still be sent.

Access, update, or delete

You may request access to, or correction of, personal information we hold about you. Where applicable law provides, you may request deletion, restriction, or portability. We will respond as required by law. (For PHI, see the HIPAA Notice of Privacy Practices.)

Do Not Track

Web browsers may send “Do Not Track” signals. Our Site does not respond to these signals, but you can control cookies as described above.

California (CPRA) & other US state rights

Residents of California (and certain other states) may have additional rights (access, correction, deletion, limit use of sensitive information, and free from discrimination for exercising rights). We do not sell or share personal information for cross-context behavioral advertising. Submit requests to contact@tikvahhealinggroup.com. We will verify your identity before fulfilling a request.

EEA/UK

You may have rights to access, rectify, erase, restrict, or object to processing, and data portability. You may also lodge a complaint with your local supervisory authority.

Children’s privacy

The Site is not directed to children under 16 and we do not knowingly collect personal information from children under 16 without appropriate consent. If you believe a child has provided personal information via the Site, please contact us and we will delete it.

Security

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information we collect through the Site. No method of transmission or storage is 100% secure. Please use the client portal/telehealth platform for sensitive health information and avoid regular email for clinical details.

External links

The Site may link to third-party websites or services. We are not responsible for their privacy practices. Review their policies before providing information.

International transfers

If you access the Site from outside the United States, your information may be processed in the U.S. or other countries that may have different data protection laws than your country.

Changes to this Policy

We may update this Privacy Policy from time to time. The “Last updated” date reflects the latest revision. Material changes will be posted on this page. Your continued use of the Site after changes means you accept the updated Policy.

1) Who we are & how these terms work

These Terms & Conditions (“Terms”) govern your access to and use of the website operated by Tikvah Healing Group (“Tikvah,” “we,” “us,” “our”) (the “Site”), and any content, forms, scheduling links, payment pages, or portals we make available through the Site (collectively, the “Services”).

By visiting or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

HIPAA & clinical services. These Terms cover the Site. If you become a client/patient, your clinical services (including telehealth) are governed by separate documents—e.g., Informed Consent, HIPAA Notice of Privacy Practices, Financial Agreement, and Practice Policies. If there’s a conflict, those clinical documents control for Protected Health Information (PHI) and care.

2) Not medical or crisis care

Information on the Site is educational/administrative only and is not medical, psychological, or legal advice, diagnosis, or treatment. The Site is not appropriate for emergencies or crises. If you need immediate help, call 911, 988 (Suicide & Crisis Lifeline), or go to the nearest emergency room.

3) Eligibility & accounts

The Site is intended for individuals 18+. Do not share your portal or scheduling credentials. You are responsible for all activity under your login.

4) Acceptable use

You agree not to: (a) break the law; (b) attempt to access non-public areas; (c) introduce malware; (d) scrape, copy, or frame the Site; (e) use automated tools without written permission; (f) infringe third-party rights; or (g) post or transmit unlawful, harassing, or confidential information you lack permission to share.

5) Intellectual property

All text, graphics, logos, audio, video, and other materials on the Site are owned by Tikvah or our licensors and protected by U.S./international IP laws. Except as expressly allowed by these Terms or our written permission, you may not copy, distribute, modify, create derivative works, or publicly display Site content.

6) Scheduling, portal, payments, and cancellations

  • Scheduling & portal. We may offer a client portal and/or scheduling via third-party platforms (e.g., [SimplePractice/Jane/TheraNest/Calendly]). Your use of those tools is also subject to the provider’s terms and privacy policy.
  • Payments. Online payments are processed by [Stripe/Square/other]. We do not store full card numbers. You promise your payment info is accurate and you’re authorized to use it. Our cancellation/no-show policy appears in your
  • Financial Agreement/Practice Policies and controls billed sessions. Any admin fees shown at checkout (if applicable) are non-refundable unless we state otherwise.

7) User submissions & feedback

If you submit comments, reviews, or suggestions (“Feedback”), you grant Tikvah a nonexclusive, worldwide, royalty-free license to use and display that Feedback to improve the Site and Services. Do not submit clinical details via general contact forms or email—use the secure client portal for PHI.

8) Third-party links & tools

Our Privacy Policy (incorporated by reference) explains how we collect and use information on the Site. For PHI, see our HIPAA Notice of Privacy Practices.

  • Email/SMS consent. If you provide a phone number or email, you consent to receive administrative messages (e.g., scheduling, reminders, receipts, policy updates). You can opt out of non-essential messages at any time.

10) Disclaimer of warranties

THE SITE AND ANY CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, TIKVAH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIKVAH AND ITS OWNERS, CLINICIANS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS; LOSS OF DATA; OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS (US $100). These limitations do not limit liability that cannot be excluded under applicable Florida law.

12) Indemnification

You agree to indemnify and hold Tikvah and our owners, clinicians, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or violation of these Terms.

13) Changes to the Site or Terms

We may update the Site and these Terms from time to time. If we make material changes, we’ll update the “Last Updated” date and, where appropriate, provide additional notice. Your continued use of the Site after changes means you accept the updated Terms.

14) Termination

We may suspend or terminate access to the Site at any time, with or without cause or notice. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) survive termination.

15) Dispute resolution, governing law, venue (Florida)

  1. Informal resolution. Before filing a claim, email contact@tikvahhealinggroup.com with a brief description of the dispute and allow 30 days to try to resolve it informally.
  2. Binding arbitration & class-action waiver. Except for small-claims matters or claims seeking injunctive relief for IP or data-security abuse, any dispute arising from or relating to these Terms or the Site will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this agreement to arbitrate.
    • Location & law. The arbitration will take place in Miami-Dade County, Florida (or by video conference if the arbitrator permits).
    • No class actions.You and Tikvah agree to arbitrate only on an individual basis—no class, consolidated, or representative actions or arbitrations.
    • Relief. The arbitrator may award individual relief permitted by law. Judgment on the award may be entered in any court with jurisdiction.
    • Fees. Each party pays its own fees and costs unless the arbitrator decides otherwise under applicable law or AAA rules.
  3. Florida law & courts. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. For matters not subject to arbitration (or to enforce arbitration awards), the state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction and venue, and you consent to personal jurisdiction there.
  4. Time limit. Any claim related to the Site must be filed within one (1) year after it accrues, or it is permanently barred (to the extent permitted by law).

16) Electronic communications & signatures

Visiting the Site, sending us emails, filling out forms, or using the portal constitutes electronic communications. You consent to receive electronic communications and agree that electronic signatures and records satisfy legal requirements for writings and signatures.

17) Severability; waiver; entire agreement

If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. These Terms (plus the incorporated Privacy Policy) are the entire agreement regarding the Site.
